Is it legitimate for the dishes on the menu to be described verbally by the waiter?



The restaurateur or entrepreneur who carries out any other food administration activity is required to display, together with the indication of the dishes he also proposes, the relative prices, including the cost of the cover charge, using signs displayed at the entrance to the premises or through a special price list made visible to the customer or in the menu.

This also applies to the offer of the day and to the so-called "off the menu", which is why in this case the waiter, in addition to indicating the dishes and the related ingredients, is also required to verbally indicate the prices of the dishes not indicated in the list.

Only in this way can the customer order with the necessary awareness and will not find any surprises at the time of the bill.

This is because a contractual relationship is established between the parties concerning the provision of food and drink upon payment of a fee which ends with the order by the customer, accepted by the restaurant, of what is proposed in menu (prices included).

It follows that the story of the dishes of the day without indication of the relative prices integrate the details of the non-fulfillment by the restaurateur such as to legitimize a possible refusal by the guest to pay the bill.

In conclusion, the verbal indication of the dishes of the day without indicating the prices of the courses is not suitable for concluding the aforementioned relationship between the parties and legitimates the customer to ask for the menu and related costs.
